Councilman Henry Davis Jr. is taking a medical leave of absence from the South Bend Common Council. As we previously reported, Henry Davis Jr. was arrested on two misdemeanor OWI charges on July 19. His court date is set for August 11.
Davis Jr. was accused of driving on the wrong side of the bypass early in the morning of July 19. The arresting officer purports that Davis Jr. failed three separate drunk driving tests, as well as a Breathalyzer test. An affidavit from the officer alleges that Davis Jr.’s blood alcohol level was .14, double the legal limit in Indiana. (You can read the full affidavit here.)
The letter to Council President Oliver Davis, as reported by ABC 57, states:
Under the advisement of legal counsel, I am unable to make a statement regarding the incident on July 19, 2014.
Further, I am temporarily taking a medical leave of absence from my duties to concentrate on my health.
